The Spanish regulator CNMC has analysed the proposals of La Liga to market the audiovisual rights of its first and second divisions in Malta, Italy, Portugal and the Netherlands.
In a statement, it says that it recommends guaranteeing a competitive, transparent, competitive and non-discriminatory award process, adding that some of the proposed conditions do not fully comply with the requirements of Royal Decree-Law 5/2015.
CNMC adds that it has approved the report while also making a number of recommendations. These include:
Guarantee a competitive award procedure, which allows the greatest possible participation of bidders, within different lots and options.
Set objective criteria for assessing the requirements for the award of lots, limiting the discretion of the LNFP and increasing certainty for operators.
Preserve the principles of publicity, transparency, competitiveness and non-discrimination in the process of awarding rights. Do not include faculties, reservations or ownership of rights not attributed by Royal Decree-Law 5/2015.
Clarify the conditions regarding linear or non-linear issuance and not discriminate between operators that carry out one or another form of issuance.
Review the duration of the contracts to seek greater competition, avoiding the closure of the market for a considerable number of years, so as to limit the possibility of submitting offers for a period of more than three years.
