A German court has sent Liberty Global’s acquisition of Kabel Baden-Wuerttemberg GmbH back to the country’s competition commission.
The Dusseldorf Higher Regional Court agreed with a Deutsche Telekom challenge that the conditions imposed by the Federal Cartel Office were insufficient.
Kabel BW was purchased by Liberty Global in March 2011 from private equity firm EQT Partners. The cost price was €3.16 billion.
Liberty Global said it would use all the legal means possible to overturn the ruling.
