Poland’s Court for the Protection of Competition and Consumers (SOKiK) has invalidated a decision by the Office of Electronic Communications (UKE) to fine the incumbent telco Telekomunikacja Polska (TP) PLN100 million (€26.49 million) for separating the fees for its Internet access service Neostrada from those for voice services. The UKE’s decision, made in September 2006, was in the court’s view wrong for – amongst other reasons – not being in accordance with the Telecom Law. SOKiK’s ruling will now probably cast doubt on UKE’s decision to also fine TP PLN338 million this February.
