
Spain’s Markets and Competition Commission (CNMC) has fined Telefónica €20 million over non-compliance with the conditions set after the 2015 acquisition of DTS (Sogecable).
It follows repeated infringements for serious breaches made by the national telco.
At the time, Telefónica agreed not to impose restrictions on pay-TV subscribers who may have wanted to leave the service.
However, from at least August 30, 2021, to April 30, 2023, Telefónica offered Movistar Fusión and MiMovistar products with pay-TV products and device leasing under conditions that included a requirement for a minimum contract and penalties for early termination.
In 2023, CNMC issued a €6 million fine over a Movistar Fusión offer that featured smartphone rental. Telefonica later expanded the offer to other devices and increased the use of minimum contract durations.
CNMC says non-compliance with commitments made in breach of competition law is seen as a serious violation.
