The Federation of German Consumer Organisations has filed a class action against streaming service DAZN over what it sees as ‘illegal’ price increases.
vzbv says DAZN, which broadcasts the Friday and Sunday matches from the Bundesliga and the Champions League increased prices in current contracts in 2021 and 2022 without the consent of users.
The Federal Office of Justice in Bonn has announced that both private individuals and small companies can now enter their claims in the so-called collective action register.
According to vzbv, the price rose from €11.99 to €14.99 per month with effect from August 2021. In the case of a one-off payment, the price rose from €119.99 to €149.99 per year from the next billing period. Prices were increased again from August 2022 from €14.99 to 29.99 per month and from €149.99 to €274.99 per year for a one-off payment.
The organisation is encouraging consumers to register claims with the Federal Office for Justice.
In an injunction brought by vzbv under competition law, the Munich Higher Regional Court considered the price adjustment clause in DAZN’s terms of use, as of February 2022, to be invalid and prohibited its use. It said the clause was too vague and prevented consumers from reviewing the justification of price increases.
