Judge orders trial in Venu Sports case

Venu Sports, the streaming JV between Disney, Warner Bros. Discovery and Fox, could be put on hold after a federal judge ordered a trial in the case brought by rival Fubo TV.

US District Court Judge Margaret M. Garnett’s decision was anticipated following comments made by Judge Garnett in bringing an earlier injunction.

“As discussed on the record with the parties at the oral argument held on December 13, 2024, Fox’s motion to sever claims and transfer venue is DENIED; Warner Bros. Discovery’s motion to dismiss is DENIED; the Disney Defendants’ motion to dismiss is DENIED; and Fox’s motion to dismiss is DENIED,” read the court record.

The trial has been set for October 2025, and is expected to take between three and four weejs, though that could change.

Venu Sports will launch in the US market and plans to bring together the owners combined portfolio of sports services and selected direct-to-consumer services in a single streaming platform.

There are concerns the launch would stifle competition and bring about higher prices for consumers.
