The Spanish regulator CNMC has initiated disciplinary proceedings against Telefónica for a possible breach of commitments in the acquisition of DTS (the former Sogecable) in April 2015.
In a statement, it says that this is part of the surveillance work carried out by the CNMC to verify that Telefónica complies with the commitments offered for the approval of the exclusive takeover of DTS The obligations assumed by Telefónica are intended to preserve competition in the markets affected by the concentration operation. CNMC adds that it authorised the acquisition in the concentration operation, conditional on Telefónica fulfilling a series of commitments, extended for an additional period of three years on July 9, 2020.
CNMC initiated the proceedings because it declared the existence of indications of non-compliance in obligation to submit information, In this instance, it was essential information to verify compliance that guarantees the effective replicability by third-party pay-TV operators of the retail offers that include Telefónica’s premium channels that are the object of the wholesale offer.
The investigation will last up to three months.
