The Spanish regulator CNMC and Association for the Self-regulation of Commercial Communication (AUTOCONTROL) have signed an agreement to promote co-regulation of commercial communications on television.
According to the new agreement, which responds to the positive assessment of both parties of the co-regulation model developed to date, the CNMC recognises the usefulness of the self-regulation of television advertising managed by AUTOCONTROL, which helps to ensure the correct application and compliance with the General of Audiovisual Communication, and other advertising regulations. Likewise, it is stated that the CNMC will support the self-regulation system for television advertising without ceasing to exercise its functions, in particular those of inspection, control and sanction on audiovisual communication services.
Other aspects of the agreement include the creation of a Commission made up of three representatives of the CNMC (one of whom will act as president) and three representatives of AUTOCONTROL (one of whom will act as secretary). This Commission will be in charge of the implementation and constant monitoring of the development and application of this agreement, of ensuring its compliance and of resolving conflicts or discrepancies, holding periodic meetings for this purpose.
