Canal+ Group is to be fined between €3 and 5 million after a ‘forced sale’ of a new package to more than 430,000 subscribers.
The decision from a court in Hauts-de-Seine came after Canal admitted liability in a procedure that allows a party to admit guilt and avoid a full trial.
The case itself dates back to December 2017 when Canal informed subscribers not receiving the CanalSat package that they could take the package for between two and five Euros.
Customers were informed that the package – and the fee – would be added to their subscription unless they notified Canal that they wanted it removed.
The court said that the practice of placing customers under obligation to refuse the offer themselves constituted the offence of sale without a prior order, a matter now recognised by Canal.
