According to the Office of Electronic Communications (UKE), the legislation will require such providers to make a payment to the Institute of 1.5% of the revenues obtained from fees for access to VOD services or issue of commercial communications, if this revenue in a given billing period is higher. Providers based in other EU states will make these payments based on their revenues in Poland.
It adds that there will nevertheless be exemptions. The payments will now not have to be made by what are termed ‘micro-enterprises’ or VOD providers who in the year preceding the one in which the obligation to pay the PISF is established did not exceed 1% of subscribers of data transmission services providing broadband internet access. The total number of such subscribers stood at 7,770,794 as of December 31, 2019.
The new provisions to art 19 section 8 of the Cinematography Act come into effect on July 1.
