Dutch cabler and ISP Ziggo does not have share information about people who have illegally downloaded film The Hitman’s Bodyguard to distributor Dutch Filmworks, appeal court judges in Arnhem said recently.
The company had demanded Ziggo to hand over the names and addresses of 377 people who, it said, had illegally downloaded the film between December 2017 and February 2, 2018.
The court ruled that DFW had not been clear enough about what it planned to do with the information and that this meant the privacy of Ziggo’s clients is more important than the alleged piracy. Nor had DFW given enough information about how it planned to fine Ziggo’s customers and what sort of fine it planned to levy, the court said in its ruling.
A lower court earlier ruled that DFW had not done enough to show that the IP address owners had actually downloaded the film, and also threw out the claim. DFW said two years ago it would take legal action against people caught illegally downloading its products.
