Poland’s Supreme Court has upheld a fine imposed on ITI Neovision, the operator of the DTH platform formerly known as n.
In a statement, the Office of Competition and Consumer Protection (UOKiK) says it concluded in April 2013 that ITI Neovision had violated the collective interests of consumers by unilaterally amending agreements.
It also questioned the manner in which ITI Neovision had provided information on the change of contract and too short a deadline it gave to customers who decided not to be automatically switched to the new DTH platform nc+.
UOKIK initially imposed a fine of over PLN10 million (€2.33 million), but after court verdicts in May 2015 and November 206 this was reduced to over PLN1.2 million.
The Supreme Court reviewed a complaint by ITI Neovision this February and decided to dismiss it.
The penalty determined by the lower courts therefore still stands.
