The Spanish regulator CNMC has fined Telefónica €5 million for failing to comply with the Subscriber Loop Access Offer (OBA).
In a statement, the CNMC says the OBA establishes relationships between Telefónica and its competitors when they lease lines (wholesalers) to provide broadband and telephone connections to their customers.
The OBA includes, among many other things, the prices of the rental of these lines (loops), times of supply and management of damages and its penalties.
Following an investigation of the period January 1, 2014 to October 31, 2015 the CNMC established that Telefónica was not responsible for a large proportion of the breakdowns in the customer lines of other operators, considering the works requested by the rival operators as a “false fault” and, consequently, applied wholesale penalties (€26.12/ line) for these efforts.
The CNMC has estimated that between 53.8% and 78.2% of the these “false faults” were incorrected inputed, thereby resulting in losses of several million euros for alternative operators, as well as affecting their image and credibitity in the eyes of their clients.
