Poland’s Constitutional Court has made a ruling favouring UPC Polska’s stance on copyright infringement.
According to Wirtualne Media, the operator argued that Article 79 of the Copyright Law, which says that knowing violators of copyright can be fined up to three times the value of those rights, is unconstitutional.
The Constitutional Court agreed that the punishment is too harsh.
UPC Polska initial lodged a complaint with the Court following a dispute with the Association of Polish Filmmakers (SFP).
It lost the dispute and had to pay millions of dollars in compensation for the non-contractual rebroadcasting of audiovisual works.
