Poland’s Office of Competition and Consumer Protection (UOKiK) has upheld a previous ruling and the size of a fine imposed on the leading DTH platform Cyfrowy Polsat.
In a statement, the UOKiK said that the ruling, made by its president in December 2009, referred to Cyfrowy Polsat’s decision to reserve the right to make changes to its programme schedule due to events outside its control.
The UOKiK was against such a provision, arguing that it would allow Cyfrowy Polsat to change its offer without modifying subscribers’ contracts.
At the same time, it did not give them the right to cancel those contracts.
The UOKiK has also confirmed the fine of PLN993,000 (€239,086) imposed on Cyfrowy Polsat, which has the right to appeal its decision.
