The Dutch Minister of Culture, Education and Science has to look into possible market distortion by the Dutch public digital channels following a ruling by the State Council (Raad van State).
The media authority Commissariaat voor de Media has failed to examine whether some thematic public broadcasting channels affect other market participants, according to the Council.
The ruling follows a complaint by MTV Networks, which objected to the thematic channels of the Dutch Public Broadcasting organisation (NPO) such as youth channel 101, Hilversum Best, Politiek24, Journaal24 and Cultura.
The State Council said that the new minister must now investigate whether the thematic channels impede commercial entrants into the market. The media authority has failed to do this.
MTV Networks has complained with the authority about the thematic channels, claiming it is distorting the market.
