The European Court of Justice is to ask Italy to require Mediaset to transfer its Rete 4 channel to satellite and cease broadcasting on its terrestrial frequencies.
According to La Repubblica, this would free up capacity for Europe 7, which has a national licence to broadcast on the frequencies. The Italian State Council had asked the Court as to whether the move was counter to EU legislation.
It’s the latest hole in the so-called Gasparri Act, the controversial media legislation introduced during the administration of Silvio Berlusconi, whose family owns the Mediasat channels.
